Welcome to CigarFinder.com. These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "user") and Marketing Loop LLC, a Nevada limited liability company doing business as CigarFinder ("CigarFinder," "we," "us," or "our"). CigarFinder® is a registered trademark of Marketing Loop LLC (U.S. Registration No. 7741263).

By accessing or using CigarFinder.com and all related services (collectively, the "Services"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately stop using the Services.

1. Eligibility and Age Requirement

The Services are intended solely for individuals who are at least 21 years of age. By using the Services, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms. CigarFinder is a tobacco-related price comparison platform. Federal "Tobacco 21" legislation makes it illegal to sell tobacco products to anyone under 21. If we learn that a user is under 21, we will immediately terminate their account and delete their data.

2. Description of Services

CigarFinder provides the following services free of charge:

•  Price Comparison: we aggregate real-time pricing from authorized online cigar retailers, allowing you to compare prices on cigars, accessories, and related products. We do not sell products directly — all purchases are completed on the retailer's website.

•  Coupon and Deal Aggregation: we collect and display verified coupon codes, promotions, and deals from our partner retailers.

•  AI Cigar Advisor: our artificial intelligence chatbot provides cigar recommendations, product information, and general cigar knowledge based on your stated preferences. See Section 8 for important disclaimers.

•  My Humidor: a virtual cigar collection manager that lets you catalog cigars you own, including photos, notes, quantities, prices, and wrapper types.

•  Cigar Journal: a personal smoking log where you can record tasting notes, ratings, strength, draw, burn, flavor, pairings, and photos for each cigar you smoke.

•  Wishlist: a feature to save products you're interested in purchasing.

•  Recently Viewed: automatic tracking of products you've browsed on the site.

•  Community Reviews: the ability to write and read product reviews.

•  Blog and Educational Content: articles, guides, and news about cigars and the cigar industry.

3. Account Registration and Security

Certain features require a free account. You may register using your email address and a password, or through a third-party social login provider (Google or Facebook). When you create an account, you agree to:

•  Provide accurate, current, and complete information.

•  Maintain and update your information to keep it accurate.

•  Maintain the security and confidentiality of your login credentials.

•  Accept responsibility for all activities that occur under your account.

•  Notify us immediately at admin@cigarfinder.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate any account that violates these Terms, is used fraudulently, or is inactive for an extended period, with or without notice.

4. User-Generated Content

4.1 Types of User Content

The Services allow you to create, upload, and store content including humidor entries, journal entries, photos, reviews, ratings, notes, and other materials (collectively, "User Content").

4.2 Your Ownership

You retain ownership of your User Content. By submitting User Content to the Services, you grant CigarFinder a non-exclusive, royalty-free, worldwide license to store, display (to you and authorized administrators), process, and back up your User Content solely for the purpose of providing and improving the Services. This license terminates when you delete your User Content or your account, except for anonymized, aggregated data that cannot identify you.

4.3 Content Standards

You agree that your User Content will not:

•  Violate any applicable law or regulation.

•  Infringe the intellectual property, privacy, or other rights of any third party.

•  Contain false, misleading, defamatory, or fraudulent information.

•  Contain malware, viruses, or harmful code.

•  Contain obscene, threatening, harassing, or hateful material.

•  Promote illegal activities or substances.

•  Impersonate any person or entity.

We reserve the right to remove any User Content that violates these standards, at our sole discretion and without prior notice.

4.4 Photo Uploads

When you upload photos to the Services (for your humidor, journal, avatar, or reviews), you represent and warrant that you own the photo or have the right to upload it, and that it does not violate any third party's rights. Photos are stored securely on our servers, automatically resized, and accessible only to you and CigarFinder administrators. Photos are permanently deleted when you delete the associated entry or your account.

5. Intellectual Property

5.1 CigarFinder's Intellectual Property

All content, features, and functionality of the Services — including text, graphics, logos, the CigarFinder® trademark, icons, images, software, source code, and the overall design and arrangement thereof — are the exclusive property of Marketing Loop LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

The CigarFinder name and logo are registered trademarks of Marketing Loop LLC (U.S. Registration No. 7741263). You may not use our trademarks without our prior written consent.

5.2 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Services except as follows:

•  You may temporarily store copies in your browser cache.

•  You may print or download one copy of a reasonable number of pages for personal, non-commercial use.

•  You may download and use your own User Content at any time.

5.3 Prohibited Uses

You may not:

•  Scrape, crawl, or use automated means to access the Services or extract data without our written consent.

•  Decompile, reverse engineer, or disassemble any software used in the Services.

•  Remove, alter, or obscure any copyright, trademark, or other proprietary notices.

•  Use the Services for any commercial purpose without our written authorization.

•  Frame, mirror, or create a browser or border environment around the Services.

•  Interfere with or disrupt the Services or the servers and networks that host them.

•  Attempt to gain unauthorized access to any part of the Services or any other systems or networks connected to the Services.

6. Third-Party Retailers and Links

CigarFinder is a comparison platform. When you click on a product listing or coupon, you will be directed to a third-party retailer's website to complete your purchase. We are not a party to any transaction between you and a retailer. You acknowledge and agree that:

•  All purchases, shipping, returns, refunds, warranties, and customer service issues are handled exclusively by the retailer.

•  Prices, availability, and coupon validity are subject to change and may differ from what is displayed on CigarFinder due to timing differences.

•  We are not responsible for the accuracy, completeness, or reliability of any information on a retailer's site.

•  Your use of a retailer's site is subject to that retailer's own terms of service and privacy policy.

•  Complaints regarding products or transactions should be directed to the retailer, not CigarFinder.

7. Affiliate Disclosure

CigarFinder earns a commission when users click through to a partner retailer's site and make a purchase. This affiliate revenue supports the free operation of our comparison tools, AI Advisor, and community features. We do not prioritize or rank retailers based on commission rates. All product listings reflect the retailer's actual prices, and we prominently display the lowest available price to help you save money.

8. AI Cigar Advisor Disclaimer

The AI Cigar Advisor is provided "as is" for informational and entertainment purposes only. You acknowledge and agree that:

•  AI-generated recommendations may be inaccurate, incomplete, or outdated.

•  The AI Advisor does not constitute professional advice of any kind, including medical, financial, or legal advice.

•  You should always verify product information, pricing, and availability directly on the retailer's website before making a purchase.

•  CigarFinder is not liable for any decisions you make based on AI Advisor recommendations.

•  The AI Advisor may not always be available due to maintenance, updates, or technical issues.

9. Account Termination and Data Deletion

You may delete your account at any time from your Profile page under Account Management. Upon account deletion, all of your personal data — including your profile, humidor entries, journal entries, photos, wishlist, recently viewed history, and reviews — will be permanently and irreversibly deleted from our systems. This action cannot be undone.

We reserve the right to suspend or terminate your account and refuse any current or future use of the Services if you violate these Terms, engage in fraudulent activity, or use the Services in a manner that could harm CigarFinder, our partners, or other users.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CIGARFINDER AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE INFORMATION, CONTENT, OR PRICES DISPLAYED ARE ACCURATE, COMPLETE, RELIABLE, OR CURRENT; (C) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (D) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (E) THE AI CIGAR ADVISOR WILL PROVIDE ACCURATE OR SUITABLE RECOMMENDATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CIGARFINDER, MARKETING LOOP LLC, OR ANY OF THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS EXCEED FIFTY DOLLARS (US $50.00). THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, AND OTHER TORTS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

12. Indemnification

You agree to indemnify, defend, and hold harmless CigarFinder, Marketing Loop LLC, and their respective affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any law or the rights of any third party; or (e) any use of your account, whether or not authorized by you.

13. Copyright and DMCA Policy

We respect the intellectual property rights of others. If you believe that any content on the Services infringes your copyright, please submit a notice to our designated copyright agent at admin@cigarfinder.com with the following information:

•  A description of the copyrighted work you claim has been infringed.

•  A description of where the allegedly infringing material is located on the Services.

•  Your contact information (name, address, phone number, email).

•  A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.

•  A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

•  Your physical or electronic signature.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of such courts.

You agree that any cause of action arising out of or related to the Services must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action is permanently barred. You agree that no claim may be brought as a class action, and you waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Services or by email. The "Effective Date" at the top of this page indicates when these Terms were last updated. Your continued use of the Services after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Services.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

17. Waiver

The failure of CigarFinder to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by CigarFinder.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CigarFinder regarding your use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

19. Assignment

You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. CigarFinder may assign these Terms or any rights or obligations hereunder without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.
